1. Description of Goods/Services
This section is where you explain what products or services your trademark will cover.
✅ Be specific – The more detailed you are, the stronger and clearer your application will be.
Example for Products:
- ❌ Do not write: “Clothes”
- ✅ Instead write: “Men’s cotton t-shirts, women’s silk dresses, leather shoes.”
Example for Services:
- ❌ Do not write: “Consulting”
- ✅ Instead write: “Legal consultancy, energy project advisory, and intellectual property filing services.”
👉 Tip: If you sell multiple products or offer multiple services, list all of them. This ensures your trademark protects everything under your brand.
2. Intent to Use vs. Actual Use
Here you will select whether you are already using your trademark in business or planning to use it in the future.
A. Intent to Use
- Choose this if you have not yet started using your trademark in commerce.
- You’ll need to select the date you plan to start using it (using the calendar provided).
- Example: “Planned launch of my clothing line on June 1, 2026.”
B. Actual Use
- Choose this if your trademark is already in use.
- You will need to provide:
- First Use Date in Commerce – the exact date you first used the mark in connection with your products/services.
- Specimen of Use – proof that your trademark is visible in real commerce (upload a product photo, packaging, or screenshot of your website).
- Website Link (optional) – add your website URL if it shows your trademark in use.
- Date of Specimen Use – the date when your uploaded specimen was first used.
👉 Tip: If you already have customers who can see your trademark on your goods/services, you should select Actual Use.
3. Why This Matters
- A clear description of goods/services ensures your trademark is registered under the correct class.
- Choosing Intent to Use or Actual Use properly helps the trademark office understand whether you are claiming current rights or future rights to your brand.
